The client should be the lawyer, but starting from the original client:
after trial they are unhappy with the result for some reason, they are prepared and able to pay some amount of money for an appeal, they have a lawyer from below whom they want to continue to work with
the lawyer should be someone who: is prepared to work with me, recognizes the need for a writer for some reason (small office, too busy to spend the time, too inexperienced in the method of appeal, knows he/she is not the one to do a logical and persuasive writing piece, simply wants to outsource for efficiency’s sake)
Most of all the lawyer needs to be prepared to pay me the retainer, give me the freedom to work independently, and be the primary communicator with his client. That lawyer may feel free to perform the oral argument for whatever writing he/she is getting done, or I will do it if he/she does not have the desire to do so.
